Impaired Driving & Over 0.08 mg%
The Facts:
Accused client arrested for impaired driving and over 0.08 after a high speed collision with another vehicle. Client blew 0.14 mg% and 0.13 mg%, and confessed to driving while impaired to the arresting officer.
The Result:
After extensive negotiations, Crown Counsel agreed to drop the criminal charges against the accused and allow her to plead guilty to the non-criminal offence of driving without due care and attention under the Motor Vehicle Act. No driving prohibition was imposed. Client was required to attend counseling and abide by a driving curfew pursuant to a s. 89 Offence Act probation order.
