Possession of Cocaine for the Purposes of Trafficking
The Facts:
Client was pulled over for a routine traffic stop. During the stop, police conducted an illegal search of his vehicle on the premise of looking for his driver’s license when the client failed to produce identification. The client was strip searched at the side of the road and detained without access to counsel while police searched his vehicle. Police located a large amount of cocaine packaged in individual dime bags and a pricing sheet.
Ms. Forhan set trial dates and brought several Charter applications alleging that police conducted an illegal search of the vehicle, an improper strip search at the roadside and a failure to facilitate access to legal counsel upon detention. After providing the prosecution with her written arguments, the Crown withdrew all charges against the client.
The Result:
Charges dropped, no criminal record.
