Possession of Cocaine

The Facts:

Accused arrested outside a nightclub in Whistler, BC for possession of cocaine. Accused was arrested for being belligerent and passing out at the front of the establishment, upon arrest a baggie of cocaine was located in his shirt pocket. Accused had no criminal record and was in Canada on a visitor’s Visa from Australia and was not a Canadian Citizen.

The Result:

Absolute Discharge. At a contested sentencing hearing in North Vancouver Provincial Court a Judge imposed an Absolute Discharge. Client left with no criminal record and no probation. Consideration was given to the fact the client was extremely intoxicated by alcohol at the time of the offence, his lack of criminal record, his young age and his reference letters from the community.
