Vancouver Criminal Lawyer: Joel Whysall
90 Day IRP
The Facts:
Police responded to the scene of a two vehicle accident. The driver parked the damaged vehicle away from the scene of the accident to clear the road. The driver was found outside of their vehicle at the scene of the accident. Visual continuity of the driver was not maintained by any witnesses or an officer. The driver was issued a 90 Day Immediate Roadside Prohibition.
The Argument:
There was insufficient evidence to support that the driver was in fact the driver of the motor vehicle.
The Result:
“Based on the evidence before me, I am not satisfied that you were the driver.”
The 90-day Immediate Roadside Prohibition was revoked and the vehicle was released.
