Client Charged With Conspiracy to Kidnap and Robbery
The Facts:
Client was charged with conspiracy to kidnap and robbery. Part of the alleged kidnapping was caught on CCTV and incriminating messages were found on a cell phone. The matter proceeded to trial.
The Argument:
Cathryn alleged the arrest was unlawful, the search and seizure of the phone was unlawful, the police used excessive force during the arrest, the police lost evidence and they violated the client’s right to counsel without delay.
The Result:
Acquitted. The Judge found that the police violated the Client’s Charter Rights and all evidence was excluded. The client was acquitted of all charges.
