Client Charged with Possession for Purpose of Trafficking
The Facts:
The accused was arrested after officer saw from a distance what looked to be a drug deal. The officer arrested the accused and searched him on the spot including checking his underwear. The officer demanded that he hand over the drugs, in which the accused complied and he was arrested for possession for the purpose of trafficking a controlled substance.
The Result:
The manner in which the search was conducted was unreasonable, it fell within the definition of a strip search and occurred in a public place. The accused was not properly informed of his Charter Rights when arrested.
