Client Charged with Possession for Purpose of Trafficking
The Facts:
The accused the registered owner of the vehicle but was in the passenger seat. The officer stopped the vehicle for not having an “N” displayed. The officers alleged they smelled marihuana in the vehicle and arrested the accused and the driver for possession of marihuana. The officers searched the vehicle incidental to arrest and located a candy container with narcotics inside and cash in the vehicle. The accused was advised that he was under arrest for possession for the purpose of trafficking.
The Result:
There was a reasonable doubt that the accused has knowledge that there were drugs in the candy container. Accused was acquitted of all charges.
