Client charged with Possession for the Purpose of Trafficking of Cocaine and Possession of a loaded prohibited firearm
The Facts:
The accused was a passenger in a vehicle pulled over for careless driving when travelling from Vancouver to Calgary. After receiving questionable identification from the accused, the police officer searched the trunk of the vehicle and found approximately one kilogram of cocaine and a loaded firearm. During subsequent search of the accused, the police officer discovered $2,000.00 in cash.
The Result:
The accused was acquitted. The cocaine and firearm were inadmissible as evidence because the police officer unreasonably detained and searched the accused. The $2,000.00 was ordered to be returned to the accused.
