Client Charged With Sexual Assault During a Date
The Facts:
Client met ex-girlfriend and went on a date. The date progressed to sexual activity. The Complainant confronted the client and said she did not want things to go that far. Complainant accused client of sexual assault. Client sent apologetic text messages. The Defence put forward that the Complainant was not a credible witness. Her version of events was inconsistent on material points. Client’s evidence was consistent that it was a consensual encounter.
The Result:
Stay of Proceedings. Crown Counsel opted to not proceed to trial.
