Credit card fraud and the law
Credit card fraud covers the theft and forgery of credit cards. Examples of credit card fraud include –
- Unauthorized use of a credit card
- Stealing a credit card
- Possessing/using/ or trafficking stolen, forged or falsified credit card data
- Creating credit cards with stolen data
- Forging credit cards
Allegations of credit card fraud are often seen alongside allegations of personation and identity theft. Cases vary dramatically in scope, ranging from lone individuals using a fake credit card to organised group criminal activity.
Penalties for credit card fraud
Credit card fraud and identity theft are distinct prosecution areas. In fact, special police investigation teams and prosecution teams are assigned to deal with these subset areas of theft and fraud.
In serious cases, the prosecution will often seek to deny bail and pursue a lengthy term of imprisonment. Even in less serious cases, the prosecution may attempt to deny bail and pursue severe sanctions.
If the case proceeds on a summary basis and you are found guilty, you could face a $5,000 fine and/or two years less one day in jail. If the matter proceeds by indictment, the maximum penalty is a 10 year jail sentence.
Defending allegations of credit card fraud
Our criminal defence lawyers represent people accused of credit card fraud and identity theft. Every case is different. During a free consultation, we can outline the strategy that will work for you.
The prosecution must show that you fraudulently used or produced credit cards. This can be difficult to do. We will question the evidence produced by the prosecution, arguing that is does not prove your guilt beyond reasonable doubt.
We work alongside our own experts, such as forensic accountants, to prove your innocence and secure your freedom.
