Importing

The offences of importing and exporting drugs is governed by the Provisions of the Controlled Drugs and Substances Act. Depending on the type of drug, the sentence can range from a non-custodial sentence up to a sentence of potential life imprisonment. The word “import” means to bring into the country or cause to bring into the country and the offence is complete when the goods enter the country. The offence requires proof of actual knowledge or willful blindness. Generally sentencing for these types of offences will attract substantial periods of incarceration, starting in the range of 10 years of imprisonment. Obtaining judicial interim release (bail) is often contentious in these type of cases and it is important at the outset to retain experienced counsel to help to ensure your release from custody.
