In Canada, every person commits an offence who operates a motor vehicle in a manner that is dangerous to the public, having regard to all the circumstances, including the nature, condition and use of the place at which the motor vehicle is being operated and the amount of traffic that at the time is or might reasonably be expected to be at that place.
If convicted summarily, a dangerous driver is liable to a fine of not more than $2,000.00 or to imprisonment for not more than 6 months, or to both. By indictment, a dangerous driver is liable to a maximum of 5 years in jail. In both cases, a dangerous driver is subject to a discretionary driving prohibition of up to 3 years.
In circumstances where a dangerous driver causes bodily harm, the driver is liable to a maximum of 10 years in jail and discretionary driving prohibition up to 10 years. If a dangerous driver has caused an accident knowing or reckless as to whether the manner of driving caused death, the driver is liable to 14 years imprisonment and discretionary driving prohibition up to 10 years.
